Please read on to learn the rules and restrictions that govern your use of our website(s), mobile app(s), products, services, applications, and/or other online or offline communications (the "Services"). ARBITRATION NOTICE AND CLASS ACTION WAIVER: EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION AGREEMENT SECTION BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

These Terms of Use are a binding contract between you and Foam Laundry Co. ("Foam," "we" and "us"). Foam Laundry Co. is incorporated in the State of Delaware and operates laundry pickup and delivery services in Salt Lake City, Utah.

1. Will These Terms Ever Change?

We are constantly trying to improve our Services, so these Terms may need to change along with our Services. We reserve the right to change the Terms at any time, but if we do, we will place a notice on our site located at foamlaundry.co, send you an email, and/or notify you by some other means.

2. What About My Privacy?

Foam takes the privacy of its users very seriously. Please see our Privacy Policy at foamlaundry.co/privacy. The Children's Online Privacy Protection Act ("COPPA") requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 16 years of age. We do not knowingly collect or solicit personally identifiable information from children under 16 years of age.

3. What Are the Basics of Using Foam?

You may be required to sign up for an account, select a password and user name, and provide us with certain information or data, such as your contact information. You promise to provide us with accurate, complete, and updated registration information about yourself. You will only use the Services for your own internal, personal, non-commercial use.

4. What About Messaging?

As part of the Services, you may receive communications through the Services, including messages that Foam sends you (for example, via email or SMS). You may opt in to receive Foam's text messages at the mobile number you provide to us. Message and data rates may apply. You can opt out by replying STOP to any text from Foam.

5. Are There Restrictions in How I Can Use the Services?

You agree not to use the Services in ways that infringe intellectual property rights, violate any law or regulation, are dangerous, harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable, or jeopardize the security of your account or anyone else's. A violation of any of the foregoing is grounds for termination of your right to use or access the Services.

6. What Are My Rights in the Services?

The materials displayed or performed or available on or through the Services are protected by copyright and/or other intellectual property laws. Subject to these Terms, we grant each user of the Services a limited, non-exclusive, non-sublicensable and non-transferable license to use Content solely for purposes of using the Services in the U.S.

11. Paid Services and Billing

Certain of our Services may be subject to payments, such as wash & fold, dry cleaning, or related services. We use a third-party payment processor to bill you through a payment account linked to your account on the Services. Some of the Paid Services may consist of an initial period, for which there is a one-time charge, followed by recurring period charges as agreed to by you.

Auto-Renewal: Unless you opt out of auto-renewal through your account settings, any Paid Services you have signed up for will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected, at the then-current non-promotional rate.

16. Legal Provisions

Warranty Disclaimer: THE SERVICES AND ALL INCLUDED CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Limitation of Liability: TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY SHALL FOAM, ITS LICENSORS, OR ITS SUPPLIERS BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

Choice of Law: These Terms are governed by and will be construed under the laws of the State of Delaware. Foam Laundry Co. is incorporated in the State of Delaware and operates its laundry pickup and delivery services in Salt Lake City, Utah.

Arbitration Agreement: You and Foam agree that any dispute, claim or controversy arising out of or relating to these Terms will be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court. The arbitration will be conducted in Salt Lake City, Utah.

17. Laundry Service Terms & Customer Responsibilities

The following terms apply specifically to Foam's laundry pickup, wash & fold, and delivery services. By using our Cleaning Services, you agree to the following:

Item Suitability: You agree that all items submitted to Foam are suitable for standard commercial laundering processes (water wash and tumble dry). Items must include manufacturer care labels.

Customer Responsibility — Pockets: YOU ARE SOLELY RESPONSIBLE FOR EMPTYING ALL POCKETS BEFORE PLACING ITEMS IN YOUR FOAM BAG. Foam is not responsible for any damage caused by items left in pockets — including but not limited to chapstick, lip balm, pens, markers, gum, coins, keys, tissues, or electronics.

Air Dry and Special Handling: YOU ARE RESPONSIBLE FOR SPECIFYING AIR DRY OR SPECIAL HANDLING PREFERENCES FOR YOUR ITEMS. Unless you explicitly designate items as "air dry" or provide special handling instructions through the Foam app or in writing, all items will be processed using Foam's standard wash and tumble dry cycle.

Lost or Damaged Items: You must report any lost or damaged items within 24 hours of your bag being returned/delivered to you. Foam's maximum liability for any single lost or damaged item is limited to the lesser of (a) the item's fair market value at the time of loss, or (b) $100 per item. In no event shall Foam's total liability for any single order exceed $100.

Stain Treatment: Foam offers stain treatment as an add-on service (starting at $3 per item). Stain treatment is performed on a "best efforts" basis. Foam does not guarantee complete removal of any stain.

Satisfaction Guarantee: If you are not satisfied with the quality of your wash, we will re-wash the affected items at no additional charge. If you are still not satisfied after the re-wash, we will issue a full refund for that order. You must report the issue within 24 hours of delivery.

Pickup and Delivery: Once your bag has been delivered to your designated delivery location, risk of loss or theft passes to you. Foam is not responsible for items left unattended at your door after delivery.
